The 168-13 ruling is not a mistake.

The Dominican Republic does not grant citizenship to all those born within its jurisdiction.

To be more specific, the Dominican Republic does not grant automatic citizenship to foreigners and their off-springs that are in transit.

The 168-13 ruling simply affirmed previous court rulings on that issue.

Like most countries where the rule of laws are enforced, the Dominican Republic has a legitimate interest in regulating immigration and having clear rules for acquisition of citizenship.

You should know that there are mechanisms in place for Haitian nationals living in the Dominican Republic to acquire Dominican citizenship.
